1. Agreement to terms
These Terms of Service ("Terms") are a legal agreement between you ("you") and Mynth ("Mynth", "we", "us"), the operator of mynth.io and the related API, SDKs, dashboard, and documentation (together, the "Service"). By creating an account, generating an API key, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
2. Eligibility
You must be at least 18 years old (or the age of legal majority where you live) to use the Service. By using the Service you represent and warrant that you meet this requirement and that all information you provide is accurate and kept up to date.
3. The service
Mynth provides a single API and SDK for generating images across many third-party AI models and providers. The Service includes related features such as Magic Prompts (prompt enhancement), automatic size selection, image storage, delivery to your own destinations, webhooks, and a dashboard for managing keys, usage, and billing.
Mynth is a router and orchestration layer. The underlying image models are operated by third-party providers, and image generation is ultimately performed by those providers. See Third-party model providers below.
4. Accounts & API keys
You need an account to use the Service. You are responsible for your account, your API keys, and all activity that occurs under them. Keep your API keys secret — treat them like passwords. Do not share them publicly or commit them to source control.
Notify us at mynth@mynth.io promptly if you believe a key has been compromised. You are responsible for usage and charges incurred through your keys until they are revoked.
5. Credits, payments & billing
The Service is prepaid. You add funds to your wallet ("credits") and your usage of the Service — image generation, Magic Prompts, and other paid features — draws down your credit balance. Prices and per-request costs are shown in the dashboard and documentation and may change over time.
Payments are processed by our payment provider (Stripe). We do not store full card details. You represent that you are authorized to use the payment method you provide. New accounts may receive a small amount of free starter credit so you can test the Service without spending real money.
Why credits are consumable: every generation costs us real money the moment a third-party provider processes it. That spend is incurred immediately and cannot be recovered by us, which is why credits are consumed as you use the Service. Please see the Refunds section below.
6. Refunds
Credits are generally non-refundable and non-transferable, and cannot be exchanged for cash. Because AI generation costs are paid out to providers as soon as a request runs, we cannot recover those costs once spent.
We will review refund requests for genuine failures
We are reasonable, and we want you to be treated fairly. If something goes wrong that is our fault, contact us and we will review a refund or credit on a case-by-case basis. Examples that may qualify:
- You were charged but no image was returned due to a failure in our system.
- A clear technical error or duplicate charge on our side.
- A documented, prolonged outage that prevented you from using credits you paid for.
What is not eligible
- Images you simply do not like, or that you consider low quality, off-style, or not what you imagined. AI output is inherently variable.
- Magic Prompt or auto-size results you are unhappy with — if a feature is not for you, you can simply stop using it.
- Generations correctly produced and delivered as requested.
- Content blocked or limited by a third-party provider's own policies.
We provide free starter credit precisely so you can evaluate the Service and our features before committing real funds. To request a review, email mynth@mynth.io with your account details and what went wrong. Refunds, where granted, are at our discretion and may be issued as account credit.
7. Acceptable use
Mynth is intentionally open. We do not impose blanket restrictions on mature, explicit, or sexual content between consenting adults, and we do not moralize about what adults create. That openness comes with a small set of firm, non-negotiable rules. You agree not to use the Service to create, request, store, or distribute content that:
- Sexualizes, exploits, endangers, or depicts minors in any way — see Child safety below. This is absolutely prohibited.
- Depicts a real, identifiable person in a sexual or intimate manner without their consent (including non-consensual intimate imagery and sexual deepfakes).
- Impersonates a real person or entity to deceive, defame, defraud, or otherwise cause harm.
- Promotes or facilitates human trafficking, sexual violence, or non-consensual acts.
- Is unlawful, infringes others' rights, or violates a third-party provider's policies.
- Harasses, threatens, or incites violence against people, or promotes terrorism or violent extremism.
You must also not abuse the Service technically: no attempts to break, overload, reverse engineer, or circumvent rate limits, security, or billing; no reselling or misrepresenting the Service; and no use of automated means to disrupt other users.
You are solely responsible for the prompts you submit and the content you generate, and for complying with all laws that apply to you and to the people who may appear in or consume that content.
8. Child safety — zero tolerance
We have zero tolerance for child sexual abuse material (CSAM) and for any sexualization or exploitation of minors. This applies to real and synthetic depictions alike, regardless of style, and there are no exceptions.
You may not use the Service to create, solicit, request, store, share, or attempt to generate any content that sexualizes, exploits, or endangers a minor, or that depicts a minor in a sexual or suggestive context. This includes content that is photorealistic, illustrated, anime/cartoon, or otherwise stylized.
We strongly respect the privacy of our users, and we do not analyze your generations for training or commercial purposes. However, protecting children overrides that privacy expectation. Where we become aware of suspected child sexual exploitation, we will act on it: we may suspend or terminate the account, preserve relevant data, report to the appropriate authorities and recognized hotlines (such as relevant law-enforcement bodies and organizations like NCMEC or INHOPE-affiliated hotlines), and cooperate with any resulting investigation, including sharing account and request details as required.
If you encounter content of this kind on or through the Service, report it immediately to mynth@mynth.io.
9. Your content & generated images
"Inputs" means the prompts, parameters, and any files you submit. "Outputs" means the images and other content the Service returns to you. You retain whatever rights you have in your Inputs, and as between you and Mynth, we do not claim ownership of your Outputs.
To the extent permitted by the models and providers involved, the Outputs are yours to use, subject to these Terms, the applicable model's license, and the law. You are responsible for ensuring you have the rights necessary for your Inputs and for how you use your Outputs.
Because generative models can produce similar results for different users and may be trained on third-party data, we cannot and do not guarantee that Outputs are original, non-infringing, or suitable for any particular purpose.
Save your own copies. During the alpha especially, do not rely on Mynth as your system of record. Storage may be cleared, and we recommend delivering generations to your own storage or destinations.
10. Third-party model providers
Image generation is performed by third-party model providers that we route requests to. Your use of those models is also subject to the relevant provider's terms and content policies, which can be more restrictive than ours. Providers may block, limit, filter, or refuse certain requests, or change pricing and availability, at their discretion and outside our control.
Where a provider blocks or restricts a request under its own policy, that is not a malfunction of the Service and is not grounds for a refund.
11. Availability & alpha status
The Service is currently offered as an early alpha. It may change, break, or be unavailable at any time, features may be added or removed, and data may be cleared during or after the alpha. We do not offer any uptime or service-level guarantee.
12. Intellectual property
The Service itself — including the API, SDKs, dashboard, documentation, branding, and underlying software — is owned by Mynth and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as permitted here. "Mynth" and our logos are our marks; you may not use them without permission.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that Outputs will meet your expectations.
14. Limitation of liability
To the fullest extent permitted by law, Mynth will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid to us for the Service in the three months before the event giving rise to the claim, or (b) USD $50.
Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Mynth from and against any claims, damages, losses, and reasonable expenses (including legal fees) arising out of your Inputs, your Outputs, your use of the Service, or your breach of these Terms or of applicable law.
16. Suspension & termination
You may stop using the Service at any time. We may suspend or terminate your access — immediately and without notice where appropriate — if you breach these Terms (especially the acceptable use or child safety sections), if required by law, or to protect the Service or others. We may also discontinue the Service or parts of it.
On termination, your right to use the Service ends. Sections that by their nature should survive (including content rules, disclaimers, liability limits, and indemnification) will survive.
17. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, take reasonable steps to let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.
18. Governing law
The Service is operated from Poland. These Terms are governed by Polish law and applicable European Union law, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections available to you where you live.
