Agreement to Terms
These Terms of Use ("Terms") govern your access to and use of websites and services operated by Mynth ("Mynth", "we", "us", "our"), including mynth.io and persona.mynth.io (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use Persona, the Persona-specific provisions below also apply and control where they conflict with the master Terms.
Eligibility and Accounts
- Minimum age: For Persona (AI persona generation and chat), you must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher. You may not use Persona if you are under this age. For other Mynth Services (if available), you must be at least 16 unless a higher age is required by law.
- Compliance: You must comply with local laws. Where local law requires a higher age, that higher age applies.
- Registration: Accounts are provided via Clerk. Provide accurate information, keep your credentials secure, and you are responsible for activity under your account.
- Account actions: We may suspend or terminate accounts for violations, fraud/abuse, or legal/compliance reasons. You may delete your account; see Data and Deletion in our Privacy Policy for effects.
Tokens, Pricing, and Payments
- Payments: Purchases and subscriptions are processed by Polar or other payment processors. Taxes may apply. Subscriptions may auto‑renew unless canceled via the customer portal.
- Tokens nature: Tokens are virtual credits used in the Services. They have no cash value, are non‑transferable, and are not redeemable for money.
- Daily free tokens: We may grant a daily allotment of free tokens (e.g., 10/day). Free tokens do not stack or roll over and may change or be discontinued.
- Purchased tokens: Purchased tokens do not expire.
- Consumption: Tokens are deducted for generation requests, retries, queued jobs, and may be deducted for partial or failed generations. Costs may vary by model/feature and may change.
- Refunds: Monetary refunds are generally not provided once tokens are consumed. We may credit or refund tokens for technical issues (e.g., failed jobs, system errors, extremely degraded quality) including via automatic refunds where implemented.
- Adjustments: We may adjust token balances to correct errors or address abuse, fraud, or misuse.
Acceptable Use and Content Policy
- Prohibited content and conduct: You may not use the Services to create, upload, or share illegal content; sexual content involving minors; non‑consensual intimate imagery; doxxing; credible threats; incitement; violent extremism; malware; or to infringe IP, trademarks, or rights of publicity/privacy, or to defame.
- Safety/accuracy: Outputs may be inaccurate, biased, or unsafe. Do not rely on outputs for medical, legal, or financial decisions. Review before use.
- Fair use: Do not bypass technical limits, rate limits, or abuse the Services (including multi‑account evasion).
Intellectual Property; Ownership and Licenses
- Your content: You retain ownership of prompts, uploads, persona data, and other content you provide ("User Content").
- Generated content: Subject to applicable law and third‑party provider policies, you own rights in AI‑generated outputs ("Generated Content"). You are responsible for ensuring your use complies with laws and third‑party rights.
- License to Mynth: You grant Mynth a worldwide, non‑exclusive, royalty‑free license to host, process, transmit, display, and create non‑substantive copies of your Content to operate, secure, and improve the Services.
- Training: We intend to opt‑out of model training where available, but some providers may process content for safety, evaluation, or training under their policies. We do not send your user ID or email to model providers in generation requests.
Third‑Party Providers and Pass‑Through Terms
The Services integrate third parties including Clerk (auth), Polar (payments), OpenRouter and upstream model vendors (text models), Runware (image generation), Bunny.net (storage/CDN), Neon (database), Vercel (hosting), Trigger.dev (background jobs), PostHog and LogSnag (analytics), and Better Stack / Logtail (logs). Your use of certain features may be subject to those providers’ terms and policies. Providers and models may change, be rate‑limited, or deprecated without notice.
Privacy and Data Use
We process account, usage, content, and metadata to provide and secure the Services, billing, fraud prevention, analytics, and support. See our Privacy Policy for details, data retention, and deletion. We use reasonable security safeguards but cannot guarantee absolute security.
Persona Addendum
Eligibility
- Persona is for adults only. You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher. Do not use Persona if you are under this age.
Adult Mode (NSFW)
- NSFW content is disabled by default and can be enabled only by toggling Adult Mode in the app.
- By enabling Adult Mode, you represent and warrant you are 18+. We may require additional verification where legally required or at our discretion. Paid tokens are not proof of age.
- Adult Mode may be unavailable in certain jurisdictions.
- Under no circumstances may you generate or upload CSAM, sexual content involving minors, or non‑consensual intimate imagery. Violations may result in immediate suspension and reporting where required.
Chats
- Storage: Persona stores your conversations/messages in our hosted database (Neon). Chats are available only to you within the app.
- Access policy: Our team does not read your chats. The only exception is when you explicitly report an issue and provide written permission for us to review specific items solely to resolve that request.
- No chat logging: We never log chat content or messages, even for debugging. We log usage only (e.g., token counts, approximate cost, model ID), never your prompts or replies.
- Providers and routing: We route text generations via OpenRouter and other providers. We do not include your account/user identifiers in headers or payloads beyond the content you choose to send; providers do not receive your user identity from us.
- Free models disclaimer: Models we offer for free may use prompts/outputs for training/evaluation per provider defaults and may be unstable, rate‑limited, or unavailable. We do not impose our own usage limits on those free models (provider limits may still apply).
- Transparency: We identify certain models with their provider (e.g., Venice) so you can review that provider’s policies. We plan to add icons/labels that communicate data usage and privacy notes for selected models as information becomes available.
- Personal data caution: Do not share sensitive or personal information in chats. You are responsible for what you choose to input.
- Roadmap: We are working on end‑to‑end encrypted chats and local‑only chat modes to maximize anonymity in the future.
Persona Generations and Tokens
- Token costs vary by model and feature and may change. Tokens may be deducted for partial/failed generations.
- Automatic token refunds may occur on detectable errors; we may issue discretionary token credits for technical issues upon request.
Publishing
Publishing personas/images to a public library is currently not supported. If/when enabled, additional terms will apply and will be communicated in‑app and in these Terms. Until then, any references to publishing are not applicable.
Disclaimers; Limitation of Liability; Indemnity
- Disclaimers: The Services are provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for a particular purpose, and non‑infringement. Outputs may be inaccurate or harmful.
- Limitation: To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid to us for the Services in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
- Indemnity: You will defend and indemnify Mynth against claims arising from your Content or use of the Services that violates these Terms, laws, or third‑party rights.
Service Changes and Availability
We may add, change, or remove features, models, or providers at any time. No SLA is provided unless in a separate agreement. Beta/experimental features may be unstable and provided without support.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Poland, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Warsaw, Poland for all disputes arising out of or relating to these Terms or the Services, unless a different forum is required by applicable consumer law.
Changes to Terms
We may update these Terms from time to time. We will post the effective date above. Continued use after changes constitutes acceptance of the updated Terms.
